Terms of Service

1. Acceptance of Terms

By accessing or using OpenShft ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

OpenShft is an Australian NDIS provider management platform. The Service is provided on a subscription basis with multiple plan tiers and includes provider, worker, and participant-facing tools for rostering, compliance, care documentation, and related operations.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use the Service.
• One person or legal entity per account.

4. Subscription & Billing

• Free Plan: Limited features, no payment required.
• Paid Plans: Billed monthly or annually through Stripe.
• Cancellation: You may cancel at any time. Access continues until the end of the billing period.
• Refunds: We offer refunds on a case-by-case basis within 14 days of purchase.
• Price Changes: We will notify you at least 30 days before any price increases.

5. Acceptable Use

You agree not to:

• Use the Service for illegal purposes
• Attempt to gain unauthorized access to other accounts
• Upload malicious code or content
• Resell or redistribute the Service without authorization
• Exceed reasonable usage limits (API calls, storage)

6. Intellectual Property

• Your Content: You retain ownership of all content you create in the Service.
• Our Service: OpenShft and its original content, features, and functionality are owned by us and protected by copyright and trademark laws.
• License: We grant you a limited, non-exclusive, non-transferable license to use the Service.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.

8. Termination

We may terminate or suspend your account:

• For violation of these Terms
• For non-payment (after reasonable notice)
• At our discretion with 30 days' notice

Upon termination, your data will be soft-deleted and permanently removed after 30 days.

9. Limitation of Liability

To the maximum extent permitted by law, OpenShft shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated at least 30 days in advance.
